Terms of Sale

1. Who these terms are for

We've written these terms for you if you're buying something from us as an individual. We use different terms for businesses.

2. Why you should read these terms

Please read these terms before you buy from us. They tell you:

  • who we are

  • how we'll deliver your order

  • what to do if something goes wrong

If you have concerns about these terms, contact us directly.

3. About us

We are Cubbie and Co., the trading name for Rich Thomas

4. Contact us

Email us at: hello@cubbieandco.shop

Write to us at: Cubbie & Co PO Box 5673 BATH BA1 0FQ

5. How we'll contact you

We'll use the contact details you gave when ordering to reach you by phone, email, or mail.

6. Who you're buying from

You're making a contract with us (Cubbie & Co), not with any other companies who help with your order.

7. When your order becomes a contract

We form a contract when we send you an "Order confirmation" email. This email shows what you've bought, the total price, and delivery costs.

8. Why we might not accept your order

We might not accept your order if:

  • we've run out of stock

  • there's a mistake in the price or description

  • we can't meet your delivery date

If this happens, we'll tell you and won't charge you.

9. Your order number

We'll give you an order number when we accept your order. Always use this number when you contact us.

10. Updates about your order

We'll email you when we start making your items and when they're ready to ship. If you order multiple items, you might get separate shipping emails.

11. Orders sent to other countries

We try to make your items close to where you live, but sometimes we'll make them elsewhere. You'll need to pay any import taxes or fees when your order arrives in your country. You'll also need to complete any paperwork and tell customs what you've ordered.

Check our Shipping guide before ordering to see where we deliver.

12. How your product might look

Your product might look slightly different from the pictures on our website. It will still work the same way and have the same quality we described.

13. Getting your order details right

You need to give us your correct size and address. If you make a mistake, we might cancel your order or charge extra costs. You're responsible for problems caused by incorrect information.

Check our Size and Fit guide before ordering.

14. Changing your order

If you need to change your order, contact us quickly. We'll tell you if this affects the price, delivery date, or other details. You must approve any changes before we make them.

15. When we might change things

We sometimes make small changes to our products for legal reasons, to fix problems, or to improve them. You'll still be able to use the product as intended.

We also update digital content sometimes. When we do, we make sure it still matches what we promised.

16. Getting your order to you

We show delivery costs at checkout. We'll deliver your order within 30 days unless we agree on a different date with you. If we agree on a specific date and miss it, you can cancel and get a full refund.

If you're not home for delivery, the driver might leave a card about redelivery or collection. If you need to collect your order, do so quickly. We won't pay extra charges if you don't.

The item becomes your responsibility once we deliver it or you collect it. You own it once you've paid in full.

17. Your right to cancel

Your rights to cancel depend on the situation.

Changed your mind

You have 14 days to cancel for any reason from the day after delivery. See section 18 for exceptions. This is called “cooling-off”.

Problem with your item

You must report faulty or misdescribed items within 30 days from the day after delivery. You can then get a repair, replacement, or refund. See section 23.

If we make a mistake

If we change the price, send the wrong item, or miss an agreed delivery date, you can cancel and get a full refund for items not received. If we break the contract in any way, you can cancel and get a refund.

18. When you can't use the “cooling-off” period

The 14-day cooling-off period doesn't apply to:

  • Items made specially for you or clearly personalised

  • Sealed products you've opened that can't be returned for health or hygiene reasons

  • Digital content (like ebooks or templates) after you've started downloading or using it and we told you you'd lose cancellation rights

19. How to cancel

Cancel by email, phone, or letter. If you've already received your order, you must return it looking new and unused. You pay for return shipping unless the item is faulty, not what you ordered, or not as described.

20. When we might cancel

We may cancel if you don't pay within 14 days after we remind you, or if you don't give us the information we need.

We can also cancel if you prevent us from delivering to the address you gave.

21. If something's wrong with your product

If you have a problem with what you bought, contact us right away. We must provide products that match what we promised.

22. Prices and paying

We'll show the total cost, including VAT, at checkout. All prices are in British Pounds (GBP). VAT rates might change between when you order and when we deliver.

We work hard to show correct prices. If we make a mistake, we'll tell you and give you the option to cancel for a full refund.

If you pay in another currency, the final price you pay will depend on your exchange rate and any charges your bank makes when buying items in a different currency. This is your responsibility.

23. Returning items

We want you to be happy with what you buy. Here's how returns work:

Changed your mind

You have 14 days from the day after the delivery to change your mind and return it.

The item must be in its original, unworn condition. You can try it on briefly like you would in a shop. It should look new with no signs of wear, washing, or use.

To start a return, complete our returns form. We'll guide you through the next steps.

Problem with your item

You have 30 days from the day after the delivery of your item to report any problems.

You can return an item if:

  • It has faults like dodgy stitching, holes, or factory stains

  • We sent you the wrong size or design

  • It doesn't match how we described it on our website

  • It isn't suitable for its intended purpose

Paying for the return

If you change your mind, you will need to cover the cost of returning the item.

For faulty items, wrong items or items not as described, we'll cover the cost of returning the item.

Getting your money back

We'll check your return within two working days. If everything's okay, we'll refund your original payment method within five working days.

Digital products

For digital items like ebooks, you lose your right to cancel once you click the download link that warns you about this.

After downloading, we can't give refunds.

24. Which laws apply

These terms follow the laws of England and Wales. Any disputes will be handled by the courts of England and Wales.

25. When we update these terms

We may update these terms occasionally. For important changes that affect your rights or our responsibilities, we'll email you at least 30 days before they start. For minor updates, we'll just post the new terms on our website. If you buy from us after we make changes, you're accepting the new terms.
